Good news from the European Cockpit Association (ECA), a member of which is also the Latvian Aviation Union (LAU). The second edition of the Pilot Peer Support Program came from the European Pilot Peer Support Initiative (EPPSI). The first edition had gained widespread interest, support and responsiveness. The program is focused on building mutual support for pilots by learning counseling skills. The aim is to develop good environment for the pilots mental health and professional development. Mental health is also vital to the flight security of the as such. The new additions to the second edition include topics about the collection of data in EPPSI, as well as the Covid, that impacted the industry:

Labi jaunumi no Eiropas Pilotu Asociācijas (EPA), kurā biedrs ir arī Latvijas Aviācijas Arodbiedrība (LAA). Ir iznācis otrais izdevums Pilotu atbalsta programmai (Pilot Peer Support Program) no Eiropas Pilotu Atbalsta Iniciatīvas (European Pilot Peer Support Initiative (EPPSI)). Pirmais izdevums bija sasniedzis plašu interesi, atbalstu un atsaucību. Programma ir vērsta uz savstarpēja atbalsta veidošanu pilotiem, apgūstot konsultācijas prasmes. Good news to flight crews! On 26 May EASA published the revised FTL Temporary Exemptions Guidelines. 

After a joint analysis of the new text within the FTL Steering Committee, we were positively surprised to see that relatively many of suggestions by European Cockpit Association (ECA) were taken on board by EASA. While some issues still remain unaddressed, we can largely conclude that the revision is a considerable improvement for air crews. Here are some improvements/changes summarized by European Cockpit Association into the list below:

 Applicability of exemptions:

    2.1.(a) – The 8 months max duration period is not explicitly mentioned in the text any more. Instead, there is a reference to Article 71 of the Basic Regulation.
    2.3. – Under this Article it was clarified that exemptions should be granted for one or several rotations (if the same type of aircraft, crew complement, departure times, layover restrictions) when no other solutions are available.
    4.12. – The NCAs should revoke exemptions without delay where the conditions causing the need for such exemptions do not prevail any more. 

 Closing the reporting loop:

    3.(f) – The operator should carry out enhanced monitoring and analysis of crew fatigue reports. Action has to be taken to address any issues identified by this exercise without delay.
    4.11. – This is a new Article stressing the need of enhanced oversight by NCAs.
    5. – NCAs should not only notify EASA of all exemptions via the Flextool, but they should also provide all data and information relevant to the particular exemption.
    7. – This is a new Paragraph stating that EASA is monitoring NCAs and will approach the NCAs where further clarifications and/or actions are needed.

 
Yet, thing missing here is the obligation of the operators to report back to NCAs on the results of the crew fatigue reports.

 Duties:

    2.2.(a) – There is no limitation on the duration of an exempted FDP (the 24 hrs reference was left out). - This still needs to be elaborated 
    2.5. – This is a new Article saying that the requirements on the class of in-flight rest facility should not be exempted.
    2.6. – This is a new Article saying that the requirements on cumulative fatigue should not be exempted.
    4.1. - Exempted FDPs should be performed by augmented crew.
    4.5. – 8 hrs minimum rest at outstation was changed to 8 hrs minimum sleep opportunity.
    4.6. – 6 hrs minimum rest at outstation in plane was changed to 6 hrs minimum sleep opportunity.  
    4.7. – During the rest period at outstation in plane not only electrical supply and temperature control should be provided, but also no loading or servicing of the aircraft should take place.
    4.9. – Meals and drinks should not only be provided during the entire rotation, but they should also be provided in appropriate quantity and time of day.

 
Commander’s discretion (CD)

    2.4. – The use of CD on top of an extended FDP should be avoided.

 FRM: Annex, Table 3, O, P – FRM was only listed as a possible mitigation measure. Operators are hence not obliged to use FRM for exempted FDPs. Also this points needs aditional analysis how it will play out in practice.

        In general, these changes are beneficial for flight crews and will help airlines  to develop socially responsible personnel policies and safer flights in the European airspace. Labas ziņas lidojumu apkalpēm! Eiropas Aviācijas Drošības Aģentūra (EASA) 26. maijā publicēja pārskatītās FTL pagaidu atbrīvojuma pamatnostādnes. Pēc tam, kad FTL Vadības komitejā tika veikta analīze kopā ar Eiropas Pilotu asociāciju par jauno tekstu, mēs visi bijām patīkami pārsteigti, redzot, ka daudzus ieteikumus EASA ir ņēmusi vērā.  Pārskatīšana ir nesusi ievērojamu uzlabojums gaisa kuģu apkalpēm, lai gan daži punkti būtu kritiskāk vērtējami. Tālāk ir norādīti daži uzlabojumi/izmaiņas no Eiropas Pilotu asociācijas (ECA) apkopojuma:


Atbrīvojumu piemērojamība:
2.1. a) – tekstā nav skaidri minēts 8 mēnešu maksimālais ilgums. Tā vietā ir atsauce uz Pamatregulas 71. pantu.

2.3. – Saskaņā ar šo pantu tika precizēts, ka atbrīvojumi jāpiešķir par vienu vai vairākām rotācijām (ja viens un tas pats gaisa kuģa tips, apkalpes papildaprīkojums, izlidošanas laiki, aizkavēšanās ierobežojumi), ja nav pieejami citi risinājumi.

4.12. – VKI nekavējoties jāatceļ atbrīvojumi, ja nosacījumi, kas rada šādu atbrīvojumu nepieciešamību, vairs nav noteicošie.


Pārskata cikla aizvēršana:
3. f) – ekspluatantam jāveic pastiprināta novērošana un apkalpes noguruma ziņojumu analīze. Ir jārīkojas, lai nekavējoties risinātu visus ar šo pasākumu noteiktos jautājumus.

4.11. – Šis ir jauns pants, kurā uzsvērta vajadzība VKI veikt pastiprinātu uzraudzību.

5. – VKI ne tikai jāpaziņo EASA par visiem izņēmumiem, izmantojot Flextool, bet arī jāsniedz visi dati un informācija, kas attiecas uz konkrēto atbrīvojumu.

7. – Šī ir jauna rindkopa, kas nosaka, ka EASA uzrauga VKI un pietuvosies VKI, kur nepieciešami turpmāki precizējumi un/vai darbības.

Tomēr te ir pazudis operatoru pienākums ziņot VKI par apkalpes noguruma ziņojumu rezultātiem.


Pienākumi:
2.2. a) – Atbrīvots FDP ilgums nav ierobežots (24 stundu atsauce tika izslēgta, kam vajadzētu tālāku vērtēšanu un pārskatīšanu). 

2.5. – Šis ir jauns pants, kurā teikts, ka nav jāatbrīvo prasības par lidojuma atpūtas telpas klasi.

2.6. – Šis ir jauns pants, kurā teikts, ka prasības par kumulatīvo nogurumu nav jāatbrīvo.

4.1. - Izņēmumi no FDTP jāveic palielinātajai apkalpei.

4.5. – 8 stundu minimālā atpūta outstation tika nomainīta uz 8 stundu minimālo miega iespēju.

4.6. – 6 stundu minimālā atpūta outstation lidmašīnā tika nomainīta uz 6 stundu minimālo miega iespēju.

4.7. – Atpūtas periodā outstation plaknē jānodrošina ne tikai elektrības padeve un temperatūras kontrole, bet arī nedrīkst notikt gaisa kuģa iekraušana vai apkalpošana.

4.9. – Ēdieni un dzērieni jānodrošina ne tikai visas rotācijas laikā, bet tie arī jānodrošina atbilstošā daudzumā un diennakts laikā.


Komandiera rīcības brīvība (CD):

2.4. – Jāizvairās no CD izmantošanas uz paplašināta FDP. 

FRM Pielikums, 3. tabula, O, P – FRM tika uzskaitīts tikai kā iespējamais mazināšanas pasākums. Tādējādi operatoriem nav pienākuma izmantot FRM atbrīvotajiem FDPs. Arī šim punktam būtu vajadzīga papildus analīze.

The role of the trade union is the representation of workers' rights and interests in contact with the employer and institutions. Members have access to social and legal support when entering the occupational community. It is also an opportunity to unite professionals and work together on the challenges of industry. The trade union stands by its members and all those in the industry in social dialogue with public authorities, legislators and decision-makers in order to improve regulation and high social standards. In this way, arobiedram offers opportunities for protection, representation and support.



How can a member of a trade union be helpful during the economic crisis?


Trade unions have historically played an important role in the development of labour law and the country also protects trade union members by law. As provided for in the Labour Act:


"Article 110. Apply a contract of employment to a member of the employee union


(1) The employer shall be prohibited to terminate an employment contract for an employee - a trade union member - without prior consent of the relevant trade union, if the employee is a trade union member for more than six months, except for the cases specified in Section 47, Paragraph one, and Section 101, Paragraph one, Clauses 4, 8 and 10 of this Law. If the employment contract is intended to be terminated in the case referred to in Section 101, Paragraph one, Clauses 7 and 11 of this Law, the employer shall inform the trade union in advance and shall consult with it.


(2) The employee trade union has a duty to inform the employer regarding its decision within a time period, but not later than within seven working days after receipt of the request of the employer. If the employee trade union does not inform the employer of its decision within a period of seven working days, the employee union shall be deemed to agree with the announcement of the employer.


(3) An employer may terminate an employment contract not later than within one month from the day when the agreement of the employee trade union has been received.


(4) If a trade union of employees does not agree with the cooling-off of a contract of employment, within a period of one month from the day of receipt of the reply, the employer may bring an action before the court regarding termination of the contract of employment. https://likumi.lv/doc.php?id=26019) ".



Therefore, a person who has registered as a member of the trade union for at least six months may obtain legal protection in the event of dismissal. If a person changes his or her job but remains a member of the union, then the occupational office accumulates and can be used as a defense at the next job, or when he returns back. Dismissal is the extreme example, but the union can also help in the event of smaller conflicts and irregularities. The crisis is both an opportunity and a time of insecurity and instability, and there is a legal guarantee in the trade union for respect for and protection of rights. They are also more likely to exist than themselves, to obtain the necessary information and to represent themselves and their colleagues together.

Arodbiedrības loma ir darba ņēmēju tiesību un interešu pārstāvība saskarsmē ar darba devēju un institūcijām. Iestājoties arodbierībā biedriem ir iespējas saņemt sociālo un juridisko atbalstu.  Tā ir arī iespēja apvienoties sava aroda profesionāļiem un kopīgiem spēkiem strādāt ar industrijas izaicinājumiem.  Arodbiedrība parstāv savus biedrus un visus industrijā strādājošos sociālajā dialogā ar valsts iestādēm, likumdevējiem un lēmumu pieņēmējiem, lai pilnveidotu regulējumu un augstus sociālos standartus. Tādā veidā arobiedrība piedāvā aizsardzības, pārstāvības un atbalsta iespējas.

Kā būt par arodbiedrības biedru var noderēt ekonomiskās krīzes laikā?

Arodbiedrībām vēsturiski ir nozīmīga loma darba tiesību attīsbā un arī valsts ar likumu aizsargā arodbiedrības biedrus. Kā paredz Darba likums:

"110.pants. Darba līguma uzteikšana darbinieku arodbiedrības biedram

(1) Darba devējam aizliegts uzteikt darba līgumu darbiniekam — arodbiedrības biedram — bez attiecīgās arodbiedrības iepriekšējas piekrišanas, ja darbinieks ir arodbiedrības biedrs vairāk nekā sešus mēnešus, izņemot gadījumus, kas noteikti šā likuma 47. panta pirmajā daļā un 101. panta pirmās daļas 4., 8. un 10. punktā. Ja darba līgumu paredzēts uzteikt šā likuma 101. panta pirmās daļas 7. un 11. punktā minētajā gadījumā, darba devējs iepriekš informē arodbiedrību un konsultējas ar to.

(2) Darbinieku arodbiedrībai ir pienākums laikus, bet ne vēlāk kā septiņu darbdienu laikā pēc darba devēja pieprasījuma saņemšanas informēt darba devēju par savu lēmumu. Ja darbinieku arodbiedrība septiņu darbdienu laikā neinformē darba devēju par savu lēmumu, uzskatāms, ka darbinieku arodbiedrība piekrīt darba devēja uzteikumam.

(3) Darba devējs var uzteikt darba līgumu ne vēlāk kā viena mēneša laikā no dienas, kad saņemta darbinieku arodbiedrības piekrišana.

(4) Ja darbinieku arodbiedrība nepiekrīt darba līguma uzteikumam, viena mēneša laikā no atbildes saņemšanas dienas darba devējs var celt prasību tiesā par darba līguma izbeigšanu. https://likumi.lv/doc.php?id=26019)".


Tādēļ cilvēks, kas ir reģistrējies kā arodbiedrības biedrs vismaz sešus mēnešus, pēc likuma, var saņemt tiesisko aizsardzību atlaišanas gadījumā. Ja cilvēks maina darbu, bet paliek kā arodbiedrības biedrs, tad arobiedrības stāžš uzkrājas un var noderēt kā aizsardzība arī nākamajā darba vietā, vai arī atgriežoties turpat atpakaļ. Atlaišana ir kā galējais piemērs, bet arodbiedrība var palīdzēt arī nelielāku konfliktu un pārkāpumu risināšananas gadījumos. Krīze ir gan kā iespēju, gan arī nedrošības un nestabilitātes laiks un esot arodbiedrībā pastāv likumiskais garants tiesību ievērošanai un aizsardzībai. Tās ir arī lielākas iespējas par sevi pastāvēt, saņemt vajadzīgo informāciju un kopīgiem spēkiem pārstāvēt sevi un savus kolēģus.
